General Terms and Conditions of Sale for Individuals
Preamble: The following provisions set out the general terms and conditions of sale for products offered by Majam on its website at the following address: majam-couture.com
By accepting the General Terms and Conditions of Sale and clicking on "Confirm your order", you definitively confirm your order.
Majam makes it impossible to purchase products without first accepting the clauses below.
The applicable terms and conditions are those in effect on the day the order is validated.
Article 1 – Purpose
These terms and conditions aim to define the sales procedures between Majam and the customer, from ordering to services, including payment and delivery. They govern all the steps necessary for placing the order and ensure the tracking of this order between the contracting parties.
Article 2 – Products
Majam's core business is offering sewing patterns, fabrics, sewing kits, other haberdashery accessories, and any other sewing-related products for sale, within the limit of available stocks. These products are those featured for sale on the day the user browses the site. When a product is out of stock, it is displayed as such on the site; otherwise, in the event of an error, Majam undertakes to notify the customer by email as soon as possible. If the product has already been paid for, Majam undertakes to refund the price of the item to the customer. The products offered for sale are described and presented with the greatest possible accuracy. However, should any errors or omissions occur in this presentation, Majam cannot be held liable. The photographs and texts illustrating the products do not fall within the contractual scope.
Majam also sells subscription products.
Article 3 – Pricing
Prices are quoted in Euros including all taxes. They take into account French VAT applicable on the day of the order. If the VAT rate were to change, these changes would be reflected in the prices of the items.
Majam reserves the right to change its prices at any time. However, prices cannot be modified once the order has been validated. The indicated prices do not include shipping costs, which will be added to the total amount of the order and specified to the customer when they finally confirm their order. Delivery in Metropolitan France takes an average of 2 to 7 days for an in-stock product from the receipt of the order by Majam, barring any accidental events or force majeure that would delay delivery independently of Majam's will and due diligence. Shipping costs depend on the delivery country. Products remain the property of Majam until full payment of the price has been received.
Article 4 – Ordering
Placing an order
Customers placing an order directly on the majam-couture.com website must follow this procedure: The customer will choose the various products they are interested in and click successively on the "Add to my cart" link. At any time, they can either get a summary of the selected products by clicking on the "My cart" link or continue shopping. The customer will finish their order by clicking on "Proceed with the order".
To properly validate their order, the customer then specifies the chosen delivery method depending on the country. The order can only be registered on the site if the customer has clearly identified themselves by entering their strictly personal email address and password. Once identified, the user must validate the delivery address, and an order form will then appear summarizing: the nature, quantity, and price of the products selected by the user, as well as the chosen payment method, the user's contact details, and the package delivery address. Any order implies acceptance of the prices and descriptions of the products available for sale.
Order validation
The order is validated once the General Terms and Conditions of Sale have been read and approved, and all fields have been completed by the customer. The order is final when the customer clicks on "Confirm". Payments are made via the PayPal service or through the Stripe payment gateway. Majam will acknowledge receipt of the order by email as soon as it is validated.
Article 5 – Payment and security
The amount owed by the customer is the amount indicated during Majam's order confirmation.
Your purchases on majam-couture.com are 100% secure thanks to the implementation of payment control and security systems. Please note that credit card payments for your order are processed directly through our payment partner: Stripe.
Providing your credit card number on the banking server when paying for your order is entirely secure. Indeed, this process is completely risk-free because your credit card details are never transmitted in plain text over the network: they are encrypted using the SSL (Secure Socket Layer) protocol.
Majam does not have access to your bank details and under no circumstances stores them on its servers. This is precisely why you are asked for them with every new transaction on our site. Entering your credit card number on the site is entirely secure. However, it is possible that a malicious person might manage to obtain your credit card number (for example, in the event of theft) and use it to place an order without your knowledge.
In any event, Majam reserves the right to refuse any order or delivery if there is an existing dispute with the customer, total or partial non-payment of a previous order, a refused credit card payment, or for other reasons that Majam reserves the right to explain to its customer. Majam cannot be held liable in any way under these circumstances.
Once the order is confirmed, the payment request is sent in real time to the secure online payment manager. The payment manager issues an electronic certificate.
Article 6 – Warranties and Right of Withdrawal
Certain products are not eligible for the right of withdrawal due to their personalized, digital, or fixed-date nature.
Consequently, cut-to-measure fabrics, digital products, and booked sewing workshops cannot be returned under the right of withdrawal, in accordance with Article L121-21-8 of the Consumer Code.
"The right of withdrawal cannot be exercised for contracts for:"
(...) 3° The supply of goods made to the consumer's specifications or clearly personalized ...".
(...) 12° The provision of accommodation services other than residential accommodation, goods transport services, car rental, catering, or leisure activities that must be provided on a specific date or period;
(...) 13° The supply of digital content not provided on a tangible medium whose performance has begun after the consumer's prior express consent...".
For products eligible for the right of withdrawal, exchanges or refunds must be made within 14 days from the date of receipt or collection.
Items must be returned within this period in their original packaging to the following address:

It is essential that the customer submits a return request by email (bonjour@majam-couture.com) to obtain return authorization. Any damaged item that was not reported or noted by the customer upon delivery will be refused by the seller. To be accepted by Majam, items must be returned in their original condition and must not have been worn. Only items returned in their original packaging (plastic pouches, etc.) will be accepted. Consequently, returns of worn items and damaged packaging will be refused. Majam therefore reserves the right to accept or refuse the returned item based on its condition and quality. All items are subject to a contractual warranty, which does not affect the statutory warranty provided for by Articles 1641 and following of the Civil Code. Customers benefit from a warranty allowing them to return defective items in accordance with Articles L 211-4 and following of the Consumer Code.
Exchanges:
Items eligible for the right of withdrawal on the majam-couture.com website can be exchanged subject to stock availability. Simply specify the item you would like in exchange when making your return request. We will process it upon receipt of your return, depending on availability. If the new order is for a higher amount, the customer must include payment for the price difference by check with the exchange request. Conversely, if the exchange amount is lower than the initial amount, the customer will receive a refund for the difference directly to their account.
To return an item, simply follow these steps:
- Send an email to "bonjour@majam-couture.com" and wait for a return authorization.
- Use the original packaging to return the product.
- Send your package to the following address: SARL MAJAM 1 rue Le Corbusier 63800 Cournon d’Auvergne. Return shipping costs are the customer's responsibility. For exchanges within France (and for exchanges only), the shipping costs for the second shipment are free.
Refunds:
Refunds will be processed along with the delivered products. Majam commits to issuing a refund within a maximum of 30 days via credit card or check, at the customer's preference. If you would like a refund for your item, send an email to "bonjour@majam-couture.com". Please include your full name, phone number, order number, and the reason for your return. Return the package by post to Majam at the following address: 1 rue Le Corbusier 63800 Cournon d’Auvergne. Please note that we do not accept cash-on-delivery packages.
Please note: You will be refunded the amount of your order, minus the initial delivery costs. However, the customer must return the item in its original condition and packaging, accompanied by Majam's return authorization.
In all cases, any request for an exchange or refund must be made by email (via the "contact" section). All items are subject to a contractual warranty, which does not affect the statutory warranty provided by Articles 1641 and following of the Civil Code.
Article 7 – Delivery
Shipping / Delivery times
Products are shipped to the delivery address provided by the customer when placing the order. All confirmed orders are shipped within 2 to 5 days. In the event of an unusual shipping delay, you will be notified by email.
The delivery times shown are estimated transit times from our carriers in business days. They are available on the Deliveries and Returns page.
For home delivery, the package is delivered to the address provided in your order summary.
For Mondial Relay delivery, the package is delivered to the pickup point address indicated in your order summary.
The delivery times indicated are estimates starting from the day after the order is shipped and correspond to product processing and delivery times. Under no circumstances can they be held against us. Majam declines all responsibility in the event of excessive delivery delays caused by postal services or transport providers, as well as in the event of loss of ordered products or strikes. Transport risks are borne by the customer, who must submit a reasoned complaint to the postal services or the carrier within three business days of delivery.
Absence / Failure to collect the package
In the event of absence for a home delivery, the postal carrier will leave a delivery notice indicating the conditions for collecting your package (location and timeframe). Holding periods are generally 14 days. You can track the progress of your package via the tracking link.
If you do not collect the package within the allotted time, it will be returned to the sender.
In the event of a request for a refund or redelivery of a package that has not been returned, Majam will apply a flat-rate processing fee of €6. To see which products are eligible for a refund, please refer to Article 6 of these Terms and Conditions.
Mondial Relay packages remain available in lockers for 5 days and at pickup points for 8 days. If you do not collect the package within the allotted time, it will be returned to the sender.
In the event of a request for a refund or redelivery of a package that has not been returned, Majam will apply a flat-rate processing fee of €6. To see which products are eligible for a refund, please refer to Article 6 of these Terms and Conditions.
Damage / Missing product
Despite all the care Majam takes in preparing packages, a product may occasionally be missing. Similarly, after transport, one of the products may prove to be defective. Therefore, upon receiving their order, the customer should check that the products received match the order. Any anomaly regarding delivery (missing or broken product, damaged package) must be reported on the very day of receipt or at the latest on the first business day following receipt to Majam's customer service by email (bonjour@majam-couture.com) or registered mail (sent to SARL MAJAM 1 rue Le Corbusier 63800 Cournon d’Auvergne).
Any complaint made after this deadline will be rejected, and Majam will be released from all liability. Majam reserves the right to ask the customer to return the defective product. If the aforementioned conditions are met, Majam will then proceed with the exchange or refund of the defective product(s), or the reshipment of the missing product (subject to the validity of the Buyer's request).
Damaged package: We ask that you do not accept a damaged package (box bearing visible signs of opening and/or deterioration): you must refuse it. Packages leaving Majam's warehouses are always in perfect condition and must be delivered to you in that state. If a damaged package has been left in your mailbox or received by your building manager, the package is considered "accepted as is." If no reservations have been made, we will not be able to take into account any missing items or proceed with compensation.
8 - Subscription contract duration – Termination
8.1 – Duration of the subscription contract
For fixed-term subscriptions, the duration of the subscription contract is specified in the subscription offer.
For subscriptions with an annual commitment, you commit for an initial period of one year from the date of subscription. At the end of the commitment period, the subscription continues without commitment.
For open-ended subscriptions, you commit for a period of one month, automatically renewable in monthly increments. Each renewal commits you for an additional month.
8.2 – Termination
8.2.1 – Termination at the subscriber's initiative
Canceling your subscription means you will stop receiving your subscription items and your subscriber benefits will end.
For an open-ended subscription, you can request cancellation every month by email at bonjour@majam-couture.com or cancel it yourself directly in your "My Account" space. A confirmation email acknowledging your request will be sent to the email address from which the request was sent.
For your cancellation to take effect at the end of the subscription period, your request must be made at least 20 calendar days before the renewal date. For technical and organizational reasons, any cancellation request made after this period cannot be taken into account for the upcoming subscription cycle, thus postponing the effective cancellation to the following period.
For a fixed-term subscription or one with an annual commitment, early termination (i.e., before the end of the subscribed commitment period) is not possible unless there is a legitimate reason.
8.2.2 – Termination at Majam's initiative
If a payment is declined, your subscription will be suspended. You will be notified by email of the declined payment and the resulting suspension of your subscription. We kindly ask that you resolve the issue as soon as possible. If no action is taken to resolve your situation within 20 calendar days of receiving the payment failure notice, we will cancel your subscription and notify you by email. To enjoy your subscription again after this, you will need to sign up for a new one.
Majam may terminate a subscription at any time without notice in the event of fraudulent or unlawful use of the Site's products and services. You will be notified of this termination and the reasons for it by email.
Article 9 – Intellectual Property
All elements of the majam-couture.com website, such as products and visuals, including the underlying technology, are protected, and any fraudulent use will be prosecuted. They are the exclusive property of Majam.
Users who have a personal website and wish to place a simple link directly to the Majam website on their site for personal use must mention the company and describe its activity. Furthermore, any hyperlink to the Majam website using framing, deep-linking, in-line linking, or any other deep-linking technique is strictly prohibited in all cases. Any link, even if tacitly authorized, must be removed upon a simple request from Majam. Hyperlinks may point to other sites besides majam-couture.com. Majam declines all responsibility if the content of these sites violates current laws and regulations.
Article 10 – Personal Data and Privacy
For business purposes, Majam reserves the right to collect personal data about site users, particularly through the use of cookies. You can find details of our data privacy policy on the Personal Data page.
To this end, the automated processing of information, including the management of users' email addresses, has been declared to the CNIL as stated in the site's legal notices.
In any case, and in accordance with the law of January 6, 1978, consumers also have the right to access and correct any information concerning them in Majam's files. Any customer of the site may at any time object to the commercial use of such data and also benefits from the right to access, correct, and delete data concerning them, directly online via the site's contact section by selecting the subject "GDPR".
Article 11 – Signature and Proof
In all cases, providing your bank card number online and finally confirming the order will serve as proof of the entire order in accordance with the provisions of the law of March 13, 2000, and will make the sums due for the items listed on the order form payable. This confirmation constitutes a signature and express acceptance of all transactions carried out on the site.
However, in the event of fraudulent use of your bank card, you are encouraged to contact Majam's customer service as soon as you notice it by sending an email to bonjour@majam-couture.com.
The computerized records stored in the computer systems of Majam and its partners under reasonable security conditions will be considered proof of communications, orders, and payments between the parties. In any case, order confirmation—whether payment is made by bank card directly on the site—constitutes a signature and express acceptance of all transactions carried out on the site.
Article 12 – Customs Duties
Any order placed on the site and delivered outside of France may be subject to potential taxes and customs duties imposed when the package reaches its destination. These customs duties and potential taxes related to the delivery of an item are the customer's responsibility. Majam is not required to check and inform its customers of applicable customs duties and taxes.
To find out about them, members are responsible for checking with the relevant authorities in their country.
Article 13 – Entire Agreement
These general terms and conditions of sale and the order summary sent to the customer form a contractual unit and constitute the entire contractual agreement between the parties.
Article 14 – Governing Law
The language of these general terms and conditions of sale is French. This contract is subject to French law. In the event of a dispute with a customer, French courts shall have sole jurisdiction.
